Terms of Use

This is an English translation provided for convenience. The French version is the original and legally binding version. In case of any discrepancy between the two, the French version prevails.

Welcome to Findkin. These Terms of Use ("Terms") govern your use of the Findkin application, published by Djulens Everly (Team Findkin), reachable at findkin.company@gmail.com.

By creating an account or using Findkin, you agree to these Terms. If you do not agree, please do not use the application.

1. Purpose of Findkin

Findkin allows creators to gather a community ("Kin") around themselves, publish announcements, challenges, projects, or content ("Next"), and allows members to join these communities, participate, react, comment, and exchange private messages.

2. Minimum age and account

You must be at least 16 years old to create a Findkin account.
You must provide accurate information when signing up.
You are responsible for keeping your password confidential and for any activity carried out from your account.
An account is personal and may not be shared or transferred.

3. Rules of conduct

By using Findkin, you agree not to:

post content that is illegal, hateful, harassing, violent, sexual in nature involving minors, or that promotes discrimination;
impersonate another person or create a fake profile;
harass, threaten, or intimidate another member;
post spam, fraudulent links, or unsolicited commercial content;
attempt to bypass the privacy settings set by a creator (Open / Members / By invitation);
use automated means (bots, scraping) to extract data from Findkin;
compromise the security or proper functioning of the service.

4. Content posted by users

You retain ownership of the content you post (text, images, projects). By posting it, you grant Findkin the right to display and distribute it to other members, within the limits of the visibility you have chosen, for the sole purpose of operating the service.
You warrant that you hold the necessary rights to any content you post (in particular images).
Findkin may remove content that violates these Terms, without prior notice.

5. Moderation, blocking and reporting

You can block another member or report content or a profile that seems inappropriate to you, directly from the application.
We reserve the right to review reports and take appropriate action (warning, content removal, account suspension or deletion), at our discretion.
Findkin is not the publisher of content posted by its members and cannot be held liable for statements or content posted by a user, but commits to acting promptly upon report of clearly unlawful content.

6. Visibility settings (Projects)

A creator may set an access level for a project: Open (visible to any signed-in member), Members (restricted to members of their Kin), or By invitation (restricted to invited people). You agree to respect these restrictions and not to attempt to access content that is not intended for you.

7. Suspension and account deletion

You may delete your account at any time from the application; this action is final.
We may suspend or delete your account in the event of a violation of these Terms, without prior notice in the event of a serious violation, or with reasonable notice in other cases.

8. No warranty

Findkin is provided "as is". We strive to ensure the availability and proper functioning of the service, but do not guarantee uninterrupted availability or the absence of errors.

9. Limitation of liability

To the extent permitted by law, Findkin cannot be held liable for indirect damages resulting from the use of the service, from content posted by users, or from interactions between members (including during meetings or collaborations organized through the application).

10. Payments

Findkin does not process any payments at this time. Labels such as "Paid", "Revenue share" or "Trade" associated with certain projects are indicative and are provided solely to inform members of the terms proposed by the creator; any financial agreement is made directly between the people concerned, outside of Findkin, at their own responsibility.

11. Changes to the service and these Terms

We may make changes to Findkin and these Terms. In the event of a substantial change, we will notify you through the application. Continued use of Findkin after a change constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by French law. Any dispute shall, failing an amicable resolution, be subject to the competent courts.
